Terms of Use

1. U.S. audience; international use at your own risk

The Services are intended for users in the United States. If you use the Services from outside the U.S., you do so at your own risk. We do not currently offer the beta as a product designed or warranted for other countries’ laws, taxes, or industry rules.

2. Free beta test

41 Degrees is currently provided as a free beta / early access test. Features may be incomplete, change, break, or be removed without notice. We may limit, suspend, or end beta access at any time. There is no guarantee of uptime, data permanence, or that beta features will appear in a paid product.

Do not rely on beta data as your only copy of important business records. Keep your own backups of critical information.

3. Eligibility & accounts

You must be able to form a binding contract under applicable U.S. law. If you create an account or join the waitlist, you agree to provide accurate information and keep credentials confidential. You are responsible for activity under your account.

4. Acceptable use

You agree not to:

• Use the Services for unlawful purposes.
• Attempt to break, probe, or overload our systems, or access data that is not yours.
• Upload malware or content you do not have the right to use.
• Resell, scrape, or misuse the Services in ways that harm 41 Degrees or other users.

5. Your content

You retain ownership of content you upload or enter (recipes, costs, documents, invoices, etc.). You grant us a limited license to host and process that content only as needed to operate and improve our software and sites (for example, providing the beta, debugging, quality, and product development), as described in our Privacy Policy.

We do not claim ownership of your business data. We do not sell it, we do not show it to other customers, and we do not use it for advertising or any purpose other than operating and improving 41 Degrees software and sites.

6. Intellectual property

The Services, branding, and software (excluding your content) are owned by 41 Degrees Software LLC and its licensors. These Terms do not transfer ownership of our IP to you.

7. Disclaimers

The Services are provided “as is” and “as available.”

To the fullest extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the beta will be error-free, secure, or uninterrupted, or that cost calculations or document readings will be complete or accurate. You remain responsible for verifying business decisions and numbers.

8. Limitation of liability

To the fullest extent permitted by law, 41 Degrees Software LLC and its affiliates will not be liable for indirect, incidental, special, consequential, or lost-profit damages, or for loss of data, arising from your use of the Services. Our total liability for any claim related to the free beta will not exceed USD $100, or the amount you paid us for the Services in the prior 12 months (if any), whichever is greater.

9. Governing law

These Terms are governed by the laws of the State of California and applicable United States federal law (without regard to conflict-of-law rules). Courts located in California will have exclusive jurisdiction over disputes arising from these Terms or the Services, except where prohibited by law.

10. Changes

We may update these Terms as the beta evolves. Continued use after changes means you accept the updated Terms. Material changes may also be noted on 41deg.com.
